Membership Agreement
1.0 Introduction
1.1 These terms and conditions and any schedules (as may be varied from time to time) shall constitute your membership agreement (“Membership Agreement”) with Classarama.
1.2 By registering as a member of Classarama, you are agreeing to accept the terms of this Membership Agreement.
1.3 Classarama Website is owned and operated by CEP North Limited, trading as Classarama, CEP North Limited is a limited liability company registered in England and Wales under company number 13307572. Classarama’s registered office is at 8b Bury Old Road, Manchester, United Kingdom, M8 9JN. Classarama’s contact details is [email protected].
2. Membership Terms
2.1 If you are under 18 years, you need your parents’ permission before becoming a member and accessing the Site.
2.2 Your Membership is non-transferable. You must not share your username and password with anyone else or allow anyone else to access the Site using your username and password.
2.3 We may terminate your Membership in the following circumstances (not limited to):
- You breach any terms of this Membership Agreement
- You provide us with false details
- Fraudulent or abusive behaviour
- Non-payment of Fees
2.4 We may sometimes need to change times or location of sessions. If we need to do this we will, where reasonably possible, send you an email notifying you of the change.
2.5 You are responsible for every use of the Site that occurs in conjunction with use of your username and password. You must use reasonable efforts to keep your username and password confidential. You must notify us as soon as you become aware of any unauthorised use of your membership, username or password.
2.6 Membership is based on periodic subscription fees which are detailed on the Site’s sign-up page. Your membership, or access to Content and areas of the Site, will be suspended or cancelled if we do not receive the fees for your subscription type.
2.7 You may be entitled to refund of subscription fees under the UK Consumer Rights Act 2015. You have the right to cancel the membership upon giving 30 days' notice period
2.8 Classarama may change these terms and conditions by posting the revised version on the Website at least 14 days before they become effective. Please check the Website from time to time. Users will be legally bound by the revised terms and conditions if they continue the Website or the services following the effective date shown.
2.9 This Membership Agreement shall be governed by English law and any disputes shall be referred to the courts of England and Wales.
3.0 Child Protection
3.1 Classarama seeks to provide the best service possible and provide a safe experience in which children can learn.
3.2 Any user who is the parent or guardian of a child under the age of 18 who has an online classroom with a tutor should not leave the child in the sole care of that Tutor.
3.3 All Tutors representing Classarama must comply with The Tutors’ Association Child Protection Policy, whether or not they are a member of The Tutors’ Association, and all relevant legislation and government guidance. 3.4 If any User has a concern regarding child protection, they should contact Classarama immediately.
4.0 Fees & Charges
4.1 The Joining Fee (if one is payable) and first month’s membership fees are collected from you by us by Direct Debit approximately 5 days from your membership application date and are not refundable under any circumstances with the exception of the Consumer Rights Act.
4.2 Your second Direct Debit for monthly membership fees only will be calculated one month after you joined. Subsequent Direct debits for monthly membership fees will be collected monthly thereafter. Each payment made is not refundable under any circumstances.
4.3 If any Direct Debit is returned unpaid and despite us having notified you of a missed payment, further payments are missed, we reserve the right to, at our sole election, either suspend or terminate your membership, upon having given you written notice of our intention to do so.
4.4 You agree to advise us immediately of any change to the Members Details provided.
5.0 Availability and Use of Site
5.1 The Site will usually be available 24 hours a day, seven days a week. We may, however, need to interrupt or suspend your access to the Site of the provision of the Site’s services and Content, for maintenance, technical or other reasons.
5.2 When accessing and using the Site and its services and Content, you must comply with directions, instructions or protocols posted on the Site.
6.0 Rights to Content; Intellectual Property
6.1 Each item of Content is copyright of its author. We own any Classarama contributed Content, and all other rights in the Site including its design, compilation and look and feel.
6.2 Your membership gives you a right (a revocable, non-exclusive licence) to use the Content for personal purposes. You must not redistribute Content (such as tutorials, eBooks, videos, courses and source files). Any project files, spreadsheets or other assets associated with Content are included to demonstrate the course or tutorial. You may use, modify and manipulate files for your own personal educational purposes, but you must not otherwise exploit the files and the assets in them, or redistribute the files or assets. If you love the Content, please ask your friends to become members too!
6.3 You may freely use the procedures and techniques demonstrated in the Content (that is, the knowledge you gain) for any commercial or personal purpose.
6.4 The trademarks and logos displayed on the Site are, unless otherwise stated, this of Students First Academy and others, and you must not use these without the approval of the relevant owner.
7.0 Fair Use and Prohibited Conduct
7.1 You are permitted to download Content to your computer as part of your membership. But your membership is subject to a ‘fair use’ policy. Our ‘fair use’ policy requires that your use of the Site and the Content must be fair, genuine and reasonable. For example, the total amount of Content you download must be reasonable in light of your genuine education and learning needs, and the time needed to genuinely engage with the Content. We will use our reasonable discretion to decide whether a member has complied with the ‘fair use’ policy.
7.2 You must not use scripts to automatically mass download Content.
7.3 You also must not:
- 7.3.1 Use a false email address, impersonate others, or misrepresent your affiliation with others
- 7.3.2 Insert advertising, branding or other promotional content into the Site or Content
- 7.3.3 Attempt to interrupt or alter the Site’s operation in any way (for example through sending mass unsolicited messages, “flooding” servers, or introducing a virus, time bomb, Trojan horse, worm, cancelbot or other computer routine)
- 7.3.4 Engage in automatic gather of information from or through the Site (such as “spidering”, “screen scraping”, “database scraping” or harvesting of email addresses)
- 7.3.5 Use the Site or the Content in a way that violates applicable law, that violates third party intellectual property or other rights, or that is, fraudulent, obscene, offensive, or defamatory
- 7.3.6 Except as allowed in these Membership Terms, copy, distribute, transmit, modify or otherwise exploit the Content or any other data or code made available through the Site
8.0 Forum and Community Rules
8.1 Please read our Forum and Community rules, which part of these Membership Terms and apply to content contributed to the Sites by members (such as comments, reviews and forum posts).
8.2 We reserve the right, but are not obliged, to monitor all matter posted to the Site. We are not responsible or liable for material posted by others. We do, however, reserve the right to edit, refuse to post or to remove matters that in our discretion are objectionable or in violation of these Membership Terms, our policies or applicable law.
9.0 Tutor's Responsibilities
9.1 Tutors are not employees of Classarama and are solely responsible for their own actions both on and off the website.
9.2 Tutors must be at least 18 years old.
9.3 Tutors must be legally entitled (possessing the relevant immigration status where relevant) to work in the UK on a self-employed basis.
9.4 Tutors are responsible for ensuring the personal information they provide. They must update this information promptly to maintain its accuracy.
9.5 Tutors must disclose any criminal convictions or cautions they may have to Classarama, including any criminal convictions or cautions received at any time after having registered a tutor account on the Website and for as long as the Tutor remains registered.
9.6 Any Tutor who, in Classarama’s opinion, fails to comply with these terms and conditions may be immediately barred from using the Website and related services.
9.7 Tutors must use their own judgement about whether they wish to offer their tuition services to each individual Student. Tutors must take every precaution to ensure that they work in a safe environment and are responsible for taking out and maintaining their own insurance policies to cover the work they undertake.
9.8 Tutors shall indemnify Classarama for all claims and liabilities arising out of any use by the Classarama of Website, including any costs and expenses incurred.
